PANAMA REAFFIRMS ITS COMMITMENT TO INTERNATIONAL COMPLIANCE
PANAMA----April 12, 2021--- The Panama Maritime Authority (AMP), the entity responsible for the administration of the Panama Ship Registry, has bolstered its operation for strengthening the application of its procedures, especially those related to due diligence and international compliance of its fleet.
The AMP has reinforced methodologies, acquired new tools, trained personnel and created new areas within the Directorate General of Merchant Marine, while implementing the highest international standards that guarantee the international compliance of the fleet.
Recently, Panama participated in the experts’ meeting on the Full Implementation of the Maritime Resolutions of the United Nations (UN)’ Security Council, of the Democratic People's Republic of Korea (DPRK), that addressed the effectiveness on DPRK of the UN application of sanctions in the maritime sector.
The experts’ meeting also considered: The registration of ships, access to ports and the provision of services to ships registered with the DPRK.
The purpose of this activity, organized by the United States and the Netherlands, was to bring together representatives of governments and authorities interested in exchanging information, improving efforts for the implementation of maritime regulations and incorporating omitted elements regarding their compliance. Representatives of Singapore, Spain, Japan, Panama, the United Kingdom and the European Union made formal presentations and interventions during the meeting which was attended by representatives of 53 countries.
Panama’s representatives reiterated their commitment to comply with the established provisions and shared the experience of the Panamanian Registry in the implementation of actions in favor of international compliance such as:
• Strengthening due diligence and its application. The Control and Monitoring Section was created which is responsible for ensuring that all vessels entering the Panamanian Registry -and those already in its fleet- comply with international norms and standards; in addition to not being involved in activities that are not aligned with the policies and commitments acquired by the Panamanian Ship Registry.
• The Implementation, Control and Enforcement of International Measures Section has been created to follow up on international norms and measures, through the verification of the official sites of organizations such as the UN’s Security Council.
• The review and update of the flagging procedure, its requirements and controls, by the Ship Registry’s Vessel Registration Department.
• The constant communication with Panama-flagged shipowners for urging them to keep their Long-Range Identification and Tracking System (LRIT) and Automatic Identification System (AIS) equipment active, as well as to stay out of conflict areas where their commercial operations could be compromised.
The purpose of these implementations and actions is to ensure that vessels and companies that own and operate vessels flying the Panamanian flag comply with international regulations on terrorism, money laundering and other illicit activities that affect both national interests and the maritime industry itself.
PANAMÁ REAFIRMA SU COMPROMISO CON EL CUMPLIMIENTO INTERNACIONAL
La Autoridad Marítima de Panamá, ente responsable de la administración del Registro de Buques de Panamá, ha reforzado su operación con la finalidad de aumentar el rango de aplicación de sus procedimientos, especialmente los relativos a la debida diligencia y el cumplimiento internacional de su flota.
Por esta razón, los esfuerzos se han dirigido a reforzar metodologías, adquirir nuevas herramientas, capacitar al personal y crear nuevas áreas dentro de la Dirección General de Marina Mercante, homogeneizando e implementando los más altos estándares internacionales, que garanticen el cumplimiento de la flota, a nivel internacional.
En este sentido, Panamá participó recientemente, en la reunión de expertos sobre la Plena Implementación de las Resoluciones Marítimas del Consejo de Seguridad de la Organización de las Naciones Unidas (ONU), de la República Popular Democrática de Corea (DPRK, por sus siglas en inglés), donde se abordaron aspectos como la eficacia de la aplicación de las sanciones de la ONU en el sector marítimo, en relación a este país.
Además, se incluyeron en dicha reunión: el control de las exportaciones, el registro de buques, el acceso a puertos y la prestación de servicios a los buques asociados a la DPRK.
La idea central de esta actividad, organizada por los Estados Unidos y los Países Bajos, fue la de reunir a representantes de gobiernos y autoridades interesadas en el intercambio de información, la mejora de esfuerzos para la aplicación de disposiciones marítimas y la incorporación de elementos omisos, referentes a su cumplimiento. En dicha reunión, en la que participaron representantes de 53 países tuvieron intervenciones y presentaciones formales los representantes de Singapur, España, Japón, Panamá, Reino Unido y la Unión Europea.
Los representantes panameños expresaron su compromiso con las disposiciones establecidas y compartieron la experiencia del Registro panameño en la implementación de acciones en pro del cumplimiento internacional como lo son:
• Fortalecimiento de la debida diligencia y su aplicación. Para esto se creó la Sección de Control y Monitoreo, la cual es responsable de asegurar que todas las naves que ingresen al Registro panameño –y las que ya se encuentran en su flota–, cumplan con las normas y estándares internacionales; además de no estar involucradas en actividades que no estén alineadas con las políticas y compromisos adquiridos por el Registro de Buques de Panamá.
• Se incorpora la Sección de Implementación, Control y Ejecución de Medidas Internacionales; que dará seguimiento a las normas y medidas internacionales, a través de la verificación de los sitios oficiales de organizaciones como el Consejo de Seguridad de ONU.
• Revisión y actualización del procedimiento de abanderamiento, sus requisitos y sus controles, por parte del Departamento de Registro de Buques.
• Comunicación constante con la flota panameña para instarlos a mantener activos sus Sistema de Identificación y Seguimiento de Largo Alcance de Buques (LRIT, por sus siglas en inglés) y su equipo de Sistema de Identificación Automática (AIS, por sus siglas en inglés); al igual que se mantengan fuera de las áreas de conflictos, en donde sus operaciones comerciales pudieran verse comprometidas.
La finalidad de estas implementaciones y acciones es que las naves y empresas dueñas y operadoras de las naves que enarbolan la bandera panameña, cumplan con la normativa internacional en materia de terrorismo, blanqueo de capitales u otras actividades ilícitas que afecten tanto a los intereses nacionales como a la propia industria marítima.
